Reporting an infringement

If you own a copyright, or act for someone who does, and believe that a mod, an image or other content on the Service infringes it, send a notice to our designated agent at founder@modgod.tech containing:

1. identification of the copyrighted work you say has been infringed (or, for several works, a representative list);
2. identification of the material you say is infringing, with enough detail for us to find it, such as the link to the mod’s page and which part of it you mean;
3. your name, mailing address, telephone number and email address;
4. a statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent or the law;
5. a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act for the owner; and
6. your physical or electronic signature.

A notice that is missing these elements may not be acted on. We may share a copy of your notice, including your contact details, with the person who posted the material.

What we do with a notice

When we receive a valid notice we remove or unlist the material promptly, tell the account that posted it what was removed and why, and give that account a copy of the notice so it can respond. We keep a record of every notice.

Contesting a removal

If your content was removed and you believe the removal was a mistake or a misidentification, you may send a counter-notice to founder@modgod.tech containing:

1. identification of the material that was removed and where it appeared before removal;
2. your name, mailing address, telephone number and email address;
3. a statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification;
4. a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, of Los Angeles County, California) and that you will accept service of process from the person who sent the original notice or their agent; and
5. your physical or electronic signature.

We forward the counter-notice to the person who sent the original notice. If they do not tell us within 10 business days that they have filed a court action to keep the material down, we may restore it between 10 and 14 business days after receiving your counter-notice.

Repeat infringers

We close the accounts of people who repeatedly infringe copyright. An account that receives more than two valid notices that are not successfully contested, or that we otherwise determine to be a repeat infringer, is closed and its unspent credits are forfeited under the Terms of Service.

False claims

Under section 512(f) of the DMCA, anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including the costs and legal fees of the person harmed. Do not send a notice or counter-notice unless you are sure of it; if you are not, consider taking legal advice first.

Other complaints

Complaints about trademarks, rights of publicity, privacy or anything else that is not a copyright go to the same address, founder@modgod.tech, with the same detail: what the material is, where it is, what right it violates and how we can reach you. Complaints about conduct that breaks the rules go through the Acceptable Use Policy.
